CONSENT FOR COLLECTION OF HEALTH DATA

This Consent for Health Data Collection ("Consent") provides an explanation of how Future Path Health Private Limited ("PaxEM", "we", "us", "our") will collect, use, store, and process your health data when you interact with PaxEM Health Platform (the "Platform"). This Consent applies to your health data only, and should be considered in conjunction with the PaxEM Privacy Policy and Terms of Service. Please review this Consent carefully. When you tap "I Agree" or grant us consent as prompted in the Platform, you give your consent to the collection and processing of your health data according to this Consent.
1. Why We Are Asking For This Consent: Health data is a type of sensitive personal data. In accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023, PaxEM seeks your express consent for processing your health-related personal data from the consent you provided while creating your account.
2. Consent for Minors and Persons Under Legal Disability: If you are a minor or a person under a legal disability who is not legally competent to provide valid consent under applicable law, this Consent must be provided by your parent, lawful guardian, or other person legally authorised to act on your behalf. By providing such consent, the parent or lawful guardian represents and warrants that they are legally authorised to do so.
3. Health Data Collected By PaxEM: Health Data means any information relating to your physical or mental health, medical condition, treatment, diagnosis, prescriptions, laboratory results, biometric information and other health-related information that identifies you. In accordance with your choices of features to use, PaxEM collects: (a) prescriptions, diagnostic test results, laboratory reports, discharge summary notes, vaccinations records, and other health history you decide to load into your Health Wallet; (b) symptoms, ailments, and other data entered through the AI chat assistant or consultation; (c) biometric, fitness, or wellness information provided via health apps or connected wearables; and (d) data used to calculate your PaxEM Health Score.
4. How We Use Your Health Data: Your health data will be used by PaxEM for the purposes of: (a) allowing you to schedule and conduct consultations with Doctors available on the Platform; (b) enabling your treating Doctor to review your health records with your consent; (c) keeping your health records stored in your Health Wallet for future reference; (d) powering our AI-enabled features mentioned in Section 5 below; and (e) determining your PaxEM Health Score in relation to the health data categories that you choose. The Health Score is provided exclusively in an indicative and informational capacity to aid you in better understanding particular elements of your health. It is neither a form of medical advice nor a method of diagnosis or treatment, nor should it be used as a replacement for the consultation of a registered medical professional.
5. Sharing Of Your Health Data: Your health data shall be disclosed only in the following manner: (a) to the Doctor who will conduct your consultation, or any other Doctor whom you subsequently consent in the future and request the access to your current records, provided you consent to this; (b) to PaxEM’s employees as necessary for providing technical assistance and operation of the Platform; and (c) to the cloud hosting service provider and AI service providers of PaxEM as detailed below in sections 5 and 6, as necessary for the corresponding features. Your Health Score or the underlying data on which it is based, is never disclosed by PaxEM to any insurer or insurance partner.
6. Processing of Your Information Through the AI: Some of the features on the Platform, which include AI Chat Assistant, AI-powered health insights, medical transcription by AI, and others, incorporate artificial intelligence technology supplied by third party service providers. In case you choose to use these features, your health data, consultation information, any document(s) you upload, prompts, questions asked and the transcript from the consultations can be processed only in order to generate the requested AI outputs. PaxEM neither reviews, verifies nor endorses the accuracy or reliability of any outputs generated through AI technology and, to the fullest extent allowed under applicable laws, disclaims any liability arising out of your reliance thereon.
The AI Assistant and Platform are not intended for medical emergencies. If you believe you are experiencing a medical emergency, immediately contact emergency services or visit the nearest hospital. Where allowed under applicable law, your use of AI-enabled features can also be processed by authorised AI service providers for the purposes of providing, maintaining, securing and improving their AI services. In case you do not want your information to be processed in such manner, then you should avoid using the AI-enabled features on the Platform.
7. Storage and Security: Your health data is stored on servers located in India, specifically in the Mumbai region. Your health data is also encrypted at rest and in transit using industry-standard security measures. Your access to your health data will be monitored and restricted to you, the Doctor(s) you have granted access to, and PaxEM employees as described in Section 5.
8. Retention: PaxEM will retain your health data for as long as your account is active, and for any period following account termination as required by applicable laws or PaxEM’s Privacy Policy.
9. Your Rights: At any point in time, you have the right to: (a) view, download or delete your health data stored in your Health Wallet on the Platform; (b) request the correction of any inaccurate health data; and (c) revoke this Consent, and in that case PaxEM will stop processing any further health data for the purposes described above. Revocation of consent may prevent you from being able to fully access certain parts of the Platform, including the Health Wallet, AI assistant and Health Score, going forward.
10. Grievances: In case of any complaints regarding your personal data, you may address PaxEM’s Dispute Resolution Officer/Privacy Officer/Data Protection Officer via: Name, Contact Information.
11. Governing Law: This Consent is subject to Indian laws, and is to be construed alongside PaxEM's Privacy Policy and Terms of Service.
